'Comments translator must free Joran'

The comments the Dutch interpretor of Joran van der Sloot made about him on the internet, have to result in a not-guilty verdict in the murdertrial of Stephany Flores. Joran’s lawyers state this in the complaint they have filed yesterday before the Inter-American human rights-commission, against the Peruvian state. Van der Sloot’s complaint comes with a claim of millions of dollars. Joran is the prime suspect in the murder of the 21 year old Flores, who’s body was found in a Lima hotelroom on May 30th, 2010.

The Dutch issue of international newspaper Metro reported two weeks ago the Dutch interpretor had made comments on Van der Sloot on the website of the Peruvian newspaper El Comercio. This was three days before he was called upon to translate at Joran’s first interrogation by Peruvian police. In several comments on the website Stein calls Joran a ‘psychopath’, for who ‘justice will be served now’.

In the complaint Joran’s lawyers state these ‘remarks of hate, reluctance and aversion’ are a violation of the American Human Rigths Convention, and the Peruvian constitution. They also blame the Peruvian state for Steins not being an official, sworn in, interpretor: ‘These are all unacceptable irregularities in the police investigation, that must lead to the conclusion that it can not be proven beyond a reasonable doubt that Joran has committed the crime.’

Translator Joran called him 'psychopath'

Joran van der Sloots human rights lawyer will include the comments Dutch translator Maurice Steins made about him on the internet, in his complaint against the Peruvian state.

According to his New York lawyer, the fact that his interpretor called Joran a 'psychopath' on the website of a Peruvian newspaper three days before his confession, was harmful to his defence. Van der Sloot has allready put out a claim of 50 million euro's to the Peruvian and Chile governments, for alledged mistakes in his extradition and failing to provide him with lawyers and translators.

Metro newspaper last week reported on the translator seeming to have made commentaries on the website of the Peruvian newspaper El Comercio. This was prior to him being present at Joran's first interrogation, on the 6th of June 2010. That week Joran was taken into custody as a suspect, in the murder of the 21 year old Stephany Flores. The translator called Joran a 'psychopath', for who 'justice' would be served now. Three days after his remarks he had to translate for Joran. In that interrogation Joran confessed to the murder.

Joran's lawyer Aldo Cotrina will file a complaint this week with the Inter-American human rights commission, he tells Metro. In this he states Steins acted 'against' the intrest of Joran, having made his remarks: "Steins showed he was being bias by putting out his comments. Also, he was not able to diagnose Joran in being a psychopath as a professional. In effect, by making his remarks and by unjustly posing as an official translator, he has helped the Peruvian government in grilling my cliënt. He needs to pay for this."

Metro looked into the response to a letter of the Peruvian National Police to the Dutch Embassy. This shows the police still had not found an official Dutch interpretor on the 16th of June 2010, with Joran's trial starting on August 2. Ambassador Barend van der Heijden informed the police his embassy could not provide for the requested interpretor. He pointed out the suspects right to be heared in his own language, by international law, and Peru's responsibility to find an interpretor.

Peruvian sollicitor Sandro Monteblanco has been briefly working Joran's case. He has studied the leaked footage on internet of the confession of Joran. He states the Spanish of the Dutchman was 'poor': "Joran was fumbling about with bad Spanglish. Policemen finished his sentences or simply made them up for him. Prosector and police are under a lot of pressure in this case. Joran had a right to an official interpretor."

'Tolk Joran was vooringenomen'

De Nederlandse tolk die de verklaring van Joran van der Sloot na de moord op Stephany Flores in Peru bij de politie vertaalde, was vooringenomen over hem. Maurice Steins noemde Joran op de website van de krant El Comercio een ‘psychopaat’. Als reageerder schreef hij ook dat er nu ‘gerechtigheid’ zou komen voor Joran. Kort daarna moest hij de verdachte bijstaan tijdens de eerste politieverhoren, waarna de 24-jarige Nederlander de moord bekende.

Steins trad eerder op in rechtszaken voor de Peruaanse justitie. Hij heeft in het land een reisbureau genaamd CuscoPeru.nl. Hij plaatste zijn commentaren over Joran op de webpagina’s van de krant op 2 en 3 juni 2010. Dit was nadat het lichaam van de 21-jarige Flores in een hotel-kamer in Lima was gevonden, en Joran naar Chili bleek te zijn gevlucht. Onder de inlognamen ‘Mauriceje’ en ‘Maurice S.’ schreef de tolk: ‘Het is zeer verdacht dat hij het land een dag later verlaat. Laten we hopen dat er deze keer gerechtigheid zal zijn.’ Met die laatste woorden leek hij te verwijzen naar het onderzoek naar de verdwijning van Natalee Holloway, waarin Joran nog steeds hoofdverdachte is. Steins schreef verder dat Joran justitie in die zaak heeft ‘bedrogen’. In een volgende reactie, over de moord op Stephany: ‘Die juffrouw liep een psychopaat tegen het lijf.’ Een dag na dit commentaar werd Joran in Chili opgepakt. Drie dagen later, op 6 juni, onderging Joran de eerste ondervragingen door de politie, met Steins daarbij als gerechtstolk aanwezig.

Hoogleraar Strafprocesrecht Theo de Roos vindt dat de uitlatingen van Steins op internet zijn vertalingen in de zaak Flores onbetrouwbaar maken: “Hij was daardoor ongeschikt om te vertalen, dat staat als een paal boven water. Maar het is aan de verdediging om dat te betwisten.” Ook advocaat Adèle van der Plas vindt dat de tolk door zijn commentaren niet onafhankelijk was: “Het kan worden gezien als het bewijs van zijn partijdigheid.” Hoogleraar Internationaal Strafrecht Göran Sluiter wijst erop dat eventuele opnames van het verhoor duidelijkheid kunnen scheppen. “De rechter moet de verklaringen van Joran in ieder geval kritisch bekijken.” Advocaat Jan Boone vindt de rol van de tolk eveneens twijfelachtig: “Een tolk die op zo’n manier zijn mening verkondigt, voordat hij de verdachte bij moet staan, kun je niet vertrouwen. Je hebt dan nooit meer de zekerheid dat de vertalingen in orde zijn.”

Hoe staat de zaak Joran ervoor?

* Omdat Jorans vertaler geen officiële tolk bleek te zijn, verzocht zijn advocaat de rechter eerder, tevergeefs, zijn bekentenis nietig te verklaren.
* Jorans tolk verbaasde zich er in een interview over dat een agent met zijn mobiel beelden maakte van de verhoren.
* Joran eist 10 miljoen dollar van Chili, omdat zijn mensenrechten zouden zijn geschaad tijdens zijn uitlevering.
* Jorans rechtszaak begint in februari. Justitie in Peru heeft 30 jaar gevangenisstraf geëist, voor moord en roof.
